Attorney Sanga Turnbull Wins Appeal for Paralyzed Client

Insurance Company Denies Benefits

Our client was riding in the back seat of a friend's vehicle when the accident occurred. He was ejected from the vehicle and suffered serious injuries, resulting in paralysis from the chest down. Although his mother carried uninsured motorist (UM) coverage, the insurance company claimed that he was only eligible for half of the benefits he was requesting.

Our client contended that since the policy provided stacked UM coverage and there were two vehicles on the insurance, he should be entitled to the benefits from both. The company denied him these benefits, so he took legal action with the help of Attorney Turnbull.

Negligent Misrepresentation Gets a Second Look

Attorney Turnbull and our client pursued a claim for negligent misrepresentation, arguing that there was misrepresentation of material fact and that the insurance company should have been aware of this misleading matter. His mother had a call with the insurance provider prior to the accident in which they explained the benefits of having stacked coverage and made statements suggesting she could claim the double coverage, even though that information was incorrect and misleading.

When her son attempted to claim the stacked benefits after his injury, he was denied. The insurance company claimed that since there was no UM on the second vehicle, it was actually not stacked for UM benefits.

Due to these discrepancies, a judge ruled that the initial trial court was wrong in dismissing the complaint and ordered that the case continue. With this latest ruling, Attorney Turnbull will have a chance to help his client hold the insurance company accountable for misrepresentation and assist him in pursuing fair compensation due to his suffering.
